These Terms of Service ("Terms") govern your use of the FlowMatic website and the services we provide. FlowMatic is based in the United Kingdom ("we", "us", "our"). By using our website or engaging our services, you agree to these Terms.

1. Our services

FlowMatic provides automation and lead-management services for estate and letting agents, including automated booking, lead response, follow-up sequences, database reactivation, and related workflows. The specific services provided to you will be agreed between us before work begins.

2. Quotes and pricing

Pricing shown on our website is indicative and excludes VAT unless stated otherwise. Final pricing, setup fees, and any pay-per-result arrangements will be confirmed with you directly before you commit. We reserve the right to update our pricing; changes will not affect work already agreed.

3. Payment terms

Monthly service plans are billed monthly in advance. Setup fees, where applicable, are payable before work begins. Pay-per-result services are charged on the terms agreed for each engagement. Plans are rolling and may be cancelled by either party with 30 days' notice unless otherwise agreed in writing.

4. Your responsibilities

To deliver our services effectively, you agree to:

  • Provide accurate information and timely access to the systems and data we need;
  • Ensure you have the right to share any contact data you provide to us, and that it complies with applicable data protection and marketing laws;
  • Honour appointments and bookings generated through our services;
  • Use our services lawfully and not for any unsolicited or non-compliant marketing.

5. Data protection

Where we process personal data on your behalf as part of our services, we do so as a data processor acting on your instructions, and you remain the data controller for that data. Both parties agree to comply with applicable UK data protection law. Our handling of data is described further in our Privacy Policy.

6. Third-party platforms

Our services rely on third-party platforms (including GoHighLevel and portal, email, and SMS providers). We are not responsible for outages, changes, or limitations of those third-party services, though we will work to minimise any disruption to you.

7. Results and disclaimers

We work hard to deliver value, but we do not guarantee specific results, lead volumes, or booking numbers, as these depend on factors outside our control (such as your market, data quality, and lead behaviour). Our services are provided on a reasonable-efforts basis.

8. Limitation of liability

To the fullest extent permitted by law, our total liability arising from or in connection with our services shall not exceed the fees you have paid to us in the three months preceding the claim. We are not liable for indirect or consequential losses, including loss of profit or business.

9. Intellectual property

Any systems, workflows, templates, and materials we create remain our intellectual property unless otherwise agreed in writing. You are granted a licence to use them for your business for the duration of our engagement.

10. Termination

Either party may terminate the agreement in line with the notice terms above. On termination, any outstanding fees become payable, and we will provide reasonable assistance to hand over your data and access.

11. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
